The Mental Capacity Act 2005 introduces the  Lasting Power of Attorney (LPA) which has now replaced the Enduring Powers of Attorney (EPA). This means that you cannot make any changes to an existing EPA or make a new one.

There are two types of LPA namely:-

  • Personal Welfare LPA

  • Property and Affairs LPA

Anyone aged 18 or over, with the capacity to do so - i.e. is not unable to manage their own affairs, can make an LPA appointing one or more Attorneys to make decisions on their behalf. You cannot make an LPA jointly with another person; each person must make his or her own LPA.

The legal document you have selected is available on request at a low cost.
