The information set out here is YesTor's Terms and
Conditions. It is important. You should read it carefully. By purchasing
our products you are agreeing to them.

About jurisdiction. YesTor provides online legal documents. They are prepared
in accordance with English Law. This is the law governing England and
Wales. Scottish and foreign law is not covered. YesTor documents may
not be recognised by other countries. If you are unsure about this
please ask us or seek guidance and advice from a lawyer specialising in the
relevant foreign law.

If you have assets other than in England and Wales they must be
governed by English law for you to use YesTor's English law documents. If
they are not then you should not use this service. If you are not sure you
should obtain your own legal advice before buying from YesTor.

YesTor provides a basic service supplying a limited and
specified series of personalised legal documents under English law only.
Every effort is made to ensure that they are correct when they are emailed to
you. But we cannot be responsible for verifying the accuracy and
correctness of information you supply to us. Neither can we be responsible
for the testamentary capacity of anyone to make a will or their ability to give
powers to attorney/s in an enduring power of attorney or to change their name.

YesTor does not offer any form of legal advice service
concerning or in addition to their service. It
is the buyer's responsibility to be sure the documents offered for purchase here are suitable for their particular needs. If you, the buyer are
unsure about this then it is important you seek your own independent legal
advice. You may also need to have had independent financial advice before
using YesTor's service.

Where name change documents are purchased for a minor -
someone who is under 18 years of age then it is the buyers obligation to
ensure that any necessary parental consents are obtained. For example
a single parent may need the consent of the absent parent to change the name
of a minor child living with them. Yestor assumes that consent is
given and you the buyer may wish to have the consent noted on the name
change. If you are in doubt seek legal advice before buying.

YesTor have a contract only with you the buyer. YesTor
have no contract with third parties on whose behalf you have ordered legal
documents.

The documents provided by YesTor stand on their own as legal
documents. Some organisations will not accept photocopies of them
unless certified as true copies by a solicitor. This does not however
affect the validity of the original document in its own right.

Most documents supplied are completed and personalised
before delivery. In the unlikely event that there appears to the buyer
that there is an error in a document then this must be drawn to our
attention. Any alterations addition or amendment if necessary must be
made only by YesTor. Alterations of any sort whether correct or not
that are made by any person other than authorised by YesTor are made at the
risk, responsibility and cost of that person or persons. YesTor are
not responsible for any consequences whatsoever that arise from use of
unauthorised or altered documents. In any event the buyer must be sure
by taking any necessary legal or other advice before purchase that a
document is suitable for the buyers purpose.

English law may change in the future. YesTor does not
assume any present or future responsibility for such changes and/or their effect, if
any, on documents previously supplied. The purchasers of YesTor's products
will themselves be responsible for future reviews of what effect any legal or
taxation changes may have on their wills or enduring powers of attorneys.
These provisions apply to you the purchaser. It is prudent that you ensure
any others on behalf of whom you have ordered documents are also aware of the
need for regularly reviews of their personal circumstances that may have
themselves changed or may be affected by changes in the law.

YesTor cannot accept responsibility for future changes in your
personal circumstances such as may render invalid void or otherwise
inappropriate any document previously provided.

Although YesTor provide guidance notes to assist you in
correctly completing your purchased documents any errors in completing or
executing any documents are not the responsibility of YesTor.

The Consumer Protection (Distance Selling) Regulations 2000 do
not apply to any purchase made by you, the consumer, from YesTor. This is
because we only offer this distance selling service online via the
internet. It is not available by telephone or post or any other
means. Each document supplied is personalised using details you the buyer
have provided in online forms. That is each legal document is drawn up for
one person based your stated requirements. This means that once a purchase
is made there is no right of cancellation. This does not affect your
Statutory Rights.

Refunds will be given at the sole discretion of YesTor.

Software and hardware considerations. YesTor supplies
completed legal documents ready to be signed as necessary. They will be
emailed to you at the address you have already supplied. The document/s
will have been prepared using Microsoft Word. You should ensure your own
software is compatible with this. The documents and accompanying notes
will be emailed to you as attachments. You should ensure these are saved
to avoid accidental loss or deletion. This is your responsibility.
The supply of duplicate documents is in the sole discretion of YesTor.

Where the proposed terms or details of any legal document you
propose are of a complexity that makes our service inappropriate YesTor will
notify you of this and make a refund of any payment. Notification will be by email and
refund will be through our secure electronic server link and to the account from
which payment was originally made. YesTor reserves the right in its
complete discretion to decline to provide any legal document. Where a
document is so declined a complete refund will be made. A deduction may be
made for any handling charges incurred in processing your electronic
payment.

About timescale. YesTor although operating only on the
internet do individually draw up legal documents. They are each
individually checked against the details you have supplied. Orders can be placed at
any time 24 hours a day and are usually prepared and emailed within 2 or 3 days.
Where you have requested printing and post we aim to post your order within
3 or 4 working days. Often we are able to send orders sooner than
these time estimates. If you have a particular timescale in mind please email us with
details first. We will endeavour to assist you.

It is a condition precedent that you agree these terms
and conditions before buying from YesTor.

Because YesTor offers a low cost personalised service
communications with buyers will only be undertaken prior to or in the course of a
purchase. For
example if a buyer seeks to appoint more than 2 executors in a will and
makes use of the 'contact us' email facility in the will making form.
There are numerous such email links throughout the web site. There will be no subsequent correspondence except in
the discretion of YesTor. All contact is via email only with the
single exception of the dispatch of documents by ordinary post if the print
and post option is selected. Posting of documents is by ordinary first
class post and an email notifying dispatch will be sent.

In the event of a mistaken purchase or repeat payment YesTor
reserves the right in the event a refund is agreed at their discretion to
deduct reasonable handling costs incurred in making any refund.

It is the responsibility of a purchaser to provide correct
information for the delivery of an order whther by email or post. If a
purchase is undeliverable for reasons beyond the control of YesTor for
example that the purchaser has not provided a working email address to
deliver documents to then YesTor are not obliged to make alternative
delivery arrangements.

Your safeguards - Whenever
you shop on UK-based retail sites as we are, there are many safeguards protecting you:

Payment. If your credit
or debit card is used fraudulently in the EU the card company must
refund you.

Websites - look for a trusted
logo. YesTor uses WorldPay for money transactions because they are
trusted.

Records - keep a note of
what you've ordered, and WorldPay's payment receipt that is emailed to
you during the payment process.

Technology helps - look
for a closed padlock sign at the bottom of the screen on the WorldPay
payment pages. It shows that your details are protected when you submit
them. You can click on the padlock for more information.

Privacy. We don't
use your details for any other purpose than fulfilling your order.
Your details are not passed on to third parties or added to mailing
lists. We only keep records for our normal accounting purposes.
They are securely destroyed in due course by shredding or burning of
paper records. When electronic records are deleted where we can we
overwrite the record with random data during the deletion process.
This is because in some computer systems a deleted file is merely marked
as space available to re-use. Until it is re-used the original
data can sometimes still be read. We avoid this loophole where
possible.

VAT - we are not
registered for VAT so do not charge you the additional 17.5%.

endeavours to provide accurate information but disclaim all warranties with
regard to the information contained on these pages. In no event or circumstance
shall YesTor be liable for any special, indirect or consequential damages or any
damages whatsoever resulting from loss of use, data or profits, whether in an
action of contract, negligence or other tortious action or the like arising out
of or in connection with the use or performance of this information. YesTor
checks the information contained in these pages for accuracy but recommends that
professional and legal advice is taken before entering into any form of
transaction or contract.
